I saw a TV news item recently.. a now-closed, NZ cannabis smoking club, had a vending machine seized by police in a raid. The court has determined that police entry to the premises was a ‘trespass & unlawful’. The machine has now been returned to the club proprietor & is now on display in the Auckland Hempstore !
I note; that I thought there is statute within NZ law for ‘unwarranted search, on the suspicion that drug-related crime is occurring’. BUT the quote from the TV item states “the police entry into (the club..) was a trespass; as a result they were inside the club unlawfully.”
“.. the evidence obtained.. is inadmissible at trial”
Maybe the whole reason this club closed.. was ‘unlawful’ ie constant surveillance & even undue harassment of members. I recognise that cannabis is currently an illegal substance in Aotearoa/NZ.. BUT the NZ is not short for NAZI !! … respect is a two-way street & there SHOULD be ‘freedom of choice’ in a fair & open society !
